Welcome to Kadmar Consultants (“Kadmar Consultants,” “Company,” “we,” “our,” or “us”). These Terms & Conditions govern your access to and use of our website, training programs, consultancy services, and auditing services.
By accessing our website or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and our Refund Policy.
If you do not agree, please discontinue use of our website and services immediately.
- Scope of Services
Kadmar Consultants provides the following professional services:
- Management Consulting (including QMS, Lean Six Sigma, process improvement)
- Training & Certification Programs (ISO 9001, IATF 16949, Core Tools, 8D, FMEA, Leadership, Green Belt, Lean Six Sigma etc.)
- Internal Audits, Gap Assessments, and Audit Support Services
- Advisory and compliance-related services
All services are delivered on a best-effort, professional basis and do not guarantee certification outcomes, audit results, regulatory approval, or financial performance improvements.
- Modifications to Terms
Kadmar Consultants reserves the right to modify or update these Terms at any time without prior notice. Changes take effect immediately upon posting on our website. Continued use of our services constitutes acceptance of the updated Terms.
- Website Use & Data Collection
We collect non-personal technical and analytical information to improve website performance and service delivery.
Personal information is collected and processed in accordance with:
Canada: Personal Information Protection and Electronic Documents Act (PIPEDA)
We do not sell or misuse client data. Confidential client information shared during consulting, training, or audits is handled with professional discretion.
- Intellectual Property Rights
All website content and service materials—including training content, audit templates, presentations, reports, tools, frameworks, logos, graphics, and documents—are the intellectual property of Kadmar Consultants unless otherwise stated.
Permitted Use
- Personal or internal organizational use
- Training participants may use materials for learning and internal application only
Prohibited Use
- Reproduction, resale, distribution, or commercial reuse
- Modification or redistribution without written authorization
- Use of Kadmar materials to provide competing services
Ownership rights are not transferred under any circumstance.
- Training, Consultancy & Certification Disclaimer
- Training certificates issued by Kadmar Consultants confirm training completion, not regulatory, ISO, IATF or CB certification.
- Kadmar Consultants is not a certification body.
- Certification outcomes depend on individual performance, organizational readiness, and third-party audit decisions.
- We provide consulting services strictly in accordance with the agreed scope of work. While we support the development, implementation, and improvement of management systems, Kadmar Consultants is not responsible for the achievement or performance of organizational metrics such as Cost of Poor Quality (COPQ), On-Time Delivery (OTD), Defective Material Rate (DMR), or other operational performance indicators, as these are influenced by internal execution, resources, and management decisions.
- Testimonials, References & Marketing Use
By engaging Kadmar Consultants, clients grant permission for:
- Use of testimonials, feedback, logos, and non-confidential project references
- Marketing, website, proposal, and promotional use
- No confidential or proprietary client information will be disclosed without consent.
- Client Responsibilities
Clients agree to:
- Provide accurate and complete information
- Assign appropriate personnel for training, audits, and consultancy
- Provide timely feedback, approvals, and access to required documentation
- Comply with agreed payment terms and schedules
Kadmar Consultants is not responsible for project delays, audit interruptions, or training limitations caused by client inaction or incomplete inputs.
- Engagement, Scheduling & Payments
- Services commence only after formal confirmation and payment
- Training seats are reserved upon payment
- Consultancy and audit timelines depend on client readiness and availability
All invoices must be paid as per agreed terms. Late payments may result in service suspension.
- Review Period & Error Corrections
- Any error occurred due to change of scope or client needs \ or error at client end will be additionally charged on fixed rate that is agreed upon both parties with minimum of $50/hour plus travel expense.
- Any delay arising from the client’s failure to provide required resources, information, access, or support in a timely manner shall remain the sole responsibility of the client. Kadmar Consultants will initiate and proceed with the project only after all agreed initial requirements, inputs, and resources are provided by the client.
- Kadmar Consultants stands behind the quality of its services. Any confirmed error or delay solely attributable to Kadmar Consultants will be addressed through corrective action at Kadmar Consultants’ own cost or, where applicable, by refund of a fixed amount not exceeding the total project fee paid. Under no circumstances shall such compensation exceed the total project cost.
- All transactions with Kadmar Consultants are conducted on a zero-interest basis. No interest, penalties, or finance charges shall apply to any payments, refunds, or compensation.
- Revisions & Scope Control
Revisions are included only when:
- The original scope remains unchanged
- Requests are reasonable and within agreed deliverables
Additional scope, rework, or consulting beyond agreement is chargeable.
- Limitation of Liability
To the maximum extent permitted by law:
- Kadmar Consultants shall not be liable for indirect, incidental, or consequential damages
- Liability is limited to the fees paid for the specific service in question
- We are not responsible for business losses, certification outcomes, regulatory penalties, or audit decisions
- Force Majeure
Kadmar Consultants shall not be held liable for delays or failures caused by events beyond reasonable control, including but not limited to natural disasters, pandemics, labor disputes, government actions, war, or technology outages.
- Governing Law & Jurisdiction
Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles.
This governing law shall apply to services provided in Canada, the United States, and any other jurisdiction.
Any dispute, claim, or proceeding arising out of or relating to this Agreement shall be resolved exclusively in the courts located in the Province of Ontario, Canada, unless otherwise expressly agreed in writing by the parties.
- Severability
If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Refund Policy
- Training, Consultancy & Audit Refunds
Eligibility
- Before service delivery: Refund minus 25%-35% administrative fee
- Training cancellations (7+ days before start): 75% refund
- Training cancellations (<7 days): 65% refund
- After training commencement: No refunds
- After consultancy or audit delivery: No refunds
Client Delays & Inactivity
- No refunds for delays caused by client non-responsiveness
- Projects inactive for 60 days are considered closed
- Reactivation requires a 25% reactivation fee
- Requesting a Refund
Refund requests must:
- Be submitted in writing to info@kadmarconsultants.com
- Include invoice number, service name, and reason
- Be within the eligible timeframe
All refunds are reviewed on a case-by-case basis at Kadmar Consultants’ discretion.
